DuPage County L-Visa Attorneys
Bensenville Lawyers for Intracompany Transfers
The United States government offers a specific type of non-immigrant work visa for executives and employees of multinational companies. This type of visa, called an L-1 visa, allows a company that operates in the U.S. to transfer eligible employees from an associated company outside of the United States.
At Unzueta Law Group, P.C., we understand that L-1 visas are only available for certain employees and that the process of obtaining an L visa can be extremely complex. Our attorneys have extensive experience in the practice of immigration law, and we are equipped to help your company obtain the L visas you need to properly conduct your business operations.
Requirements for an L Visa
There are two subcategories of the L-1 visa. The L-1A visa is meant for employees who work in a managerial or executive capacity, while the L-1B visa allows employees in specialized knowledge positions to work in the United States. In order to be eligible to file a petition for an L-1 visa, two basic requirements must be met:
- There must be a qualifying relationship between the company in the United States and the company in another country. A qualifying relationship could include parent company, subsidiary, affiliate, or branch; and
- The employee to be transferred to the United States must have been employed by the same employer abroad continuously for one year within the three years prior to the transfer.
Smaller companies with qualifying relationships abroad must file separate petitions with the United States Citizenship and Immigration Services (USCIS) for each intended transfer. However, large multinational companies could be eligible to file blanket L-1 petitions to facilitate the transfer of multiple employees.
If approved, an L-1 visa is granted for an initial period of three years and may be renewed for up to seven years for an L-1A visa and for up to five years for an L-1B visa. Depending on the circumstances, subsequent renewals may be possible. In some cases, an L-1 visa can be converted to a permanent work visa.
